If you use a DuPont Certified Fabricator for Installation:
If you use a DuPont Certified Fabricator/Installer to template, fabricate and install your Simplicity® product, DuPont will, at its option, repair or replace upon the terms of this warranty, the Simplicity® product if it fails due to any manufacturing defect or installation defect (as determined at the sole discretion of DuPont or a DuPont authorized warranty service agent) during the first 10 years after installation, except for damages caused by physical, chemical or other abuse, damage from excessive heat, acts of nature or any other exception set out in this warranty.

If you do not use a DuPont Certified Fabricator for Installation:
If you elect to install your Simplicity® product yourself or have anyone other than a DuPont Certified Fabricator/Installer perform the installation of this product, then your warranty is for defective product only (as determined at the sole discretion of DuPont or a DuPont warranty service agent), except any installation defects will not be covered and nor will any damages caused by physical, chemical or other abuse, damage from excessive heat, acts of nature or any other exception set out in this warranty. DuPont’s only obligation hereunder will be to provide replacement product, although DuPont may elect, at its sole option and its sole benefit, to provide repair pursuant to the terms in this warranty.

Other Warranty Guidelines:
This warranty does not cover damage caused by:

• Physical, chemical or other abuse includes improper use of the product in applications or means that are unreasonable considering the normal and expected uses of such installations in a residence, and includes, but is not limited to, damage from vandalism, use of improper cleaning solutions, leaving substances such as bleach or drain cleaner on the product without prompt cleaning, the dropping of heavy objects on the countertop or in the sink, or product which has not been maintained in accordance with the DuPont Care and Use Guide, which is available on the website referenced below.
• Excessive heat includes exposure to heat of such a degree that white marks, white rings or cracks appear on the product. Cracking around a cook top may appear by permitting cookware on a heating element to overhang the countertop causing excessive heat on the countertop, or from using high temperatures nearby for lengthy periods of time. Common sense should be exercised by using a rubber footed trivet or other insulating device when placing a hot object onto the product or when exposing the product to heat.
• Acts of nature include, but are not limited to, exposure to the outdoors, weather effects and fire and any damage or injury caused in whole or in part by acts of God, job or worksite conditions, architectural and engineering design, structural movement or settling, or accidents or breakage not arising directly from a defect in the product manufacturing process.
• Faulty or improper installation includes any damage caused by or arising out of improperly installed, used or maintained appliances (including garbage disposals) which are either built into the installation or placed or stored on the Simplicity® product.
• Measurements are not covered under this warranty if you provided measurements for the fabrication or templating of the Simplicity® product and they were faulty or inaccurate in any manner whatsoever. Proper measurements will only be covered under the installation warranty if a DuPont Certified Fabricator/Installer took the measurements and performed the installation.

• Products made by other suppliers or manufacturers, including other solid surface products.
• Failure of any caulk, adhesive, or other finishing or maintenance accessory, or failure of any caulked or filled joint or seam performance, or any other aspect of the installation process, including seam appearance.
• Dissatisfaction with the color of the product. If during or after fabrication or installation of your Simplicity® product, you decide that you do not like the color you selected, replacement of the product is not covered by this warranty. Printed representation of colors at your retailer or on our website may vary from actual samples. Accordingly, actual samples of Simplicity® should be used for your final color selection, which samples should be viewed in your home, as your lighting conditions may be different from those where you have viewed the samples. Samples may be purchased at the website shown below. The warranty does not cover a mismatch between printed representation and the actual product color.
• You will be responsible for any and all other costs associated with or arising out of any repair or replacement of Simplicity® product, including, but not limited to the removal of the original product, any modifications and reinstallation, including plumbing and seaming costs.

Specific Rights
DuPont’s obligation is limited solely as described herein. In providing repair or a replacement product, DuPont will seek to obtain the best possible result, but exact color match cannot be guaranteed. Your warranty will continue from the original date of purchase and not from the date or repair or receipt of replacement product.

No implied or expressed warranty of merchantability or fitness for a particular purpose is granted by this warranty except as expressly stated herein. Except as provided herein, DuPont shall not be liable in either tort or contract for any loss or direct, consequential or incidental damages arising out of the use or inability to use the Simplicity® product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. You shall reasonably cooperate with DuPont or its representatives in their efforts to perform their obligations under these warranties.

The foregoing is the only warranty made by DuPont for Simplicity® products. No representative, dealer, retailer, fabricator/installer or any other person is authorized to make or makes any warranty, representation or promise on behalf of DuPont with respect to such products. No terms or conditions other than those stated herein or provided by law, and no agreement or understanding, oral or written, in any way purporting to modify this warranty shall be binding on DuPont unless made in writing and signed by an authorized employee of DuPont.
